The concept of a trademark refers to a designation that serves to individualize goods, work performed or services of legal entities or individuals.

A trademark is a designation that consumers need to distinguish the goods and services of certain legal entities or individuals from the goods and services of other legal entities or individuals.

The law recognizes the exclusive right to a trademark, which is certified by a trademark certificate. In other words, the trademark holder has the right to use this trademark, to dispose of it and to prohibit its use by other persons, but only in civilian traffic, in particular:

on goods, on labels, packages of these goods that are produced, sold, advertised or otherwise entered into public circulation

when performing work, providing services (in the case of a service mark);

on the documentation related to the introduction of goods into civilian circulation;

in proposals for the sale of goods, performance of works, rendering services, as well as in ads, on signboards and in advertising;

on the Internet, in particular in the domain name and other ways of addressing.

Various trademarks can be used as trademarks: verbal, figurative, three-dimensional, combined, sound, three-dimensional and other designations, combinations of these elements can also be used. Also, a trademark can be registered in any color or color combination.

In order to obtain exclusive rights to a trademark (to become a copyright holder), it is necessary to register the trademark with an authorized state body. After registration of a trademark, the right holder receives a certificate for the trademark. The validity of such a certificate is 10 years from the date of filing of the application with the Patent Office. During the last year of action, at the request of the owner, after paying the corresponding state fee, the certificate may be extended for a period of 10 years, and so an unlimited number of times.
